While any broker or agent can help you locate a property and negotiate a purchase price, their service to you unfortunately becomes very limited upon one of the most important parts of your real estate transaction.
Imagine that you’ve gone through the legwork of finding a property . . . you’ve taken the time with your agent to reach a purchase price that the seller has accepted . . . but now you have many questions regarding the volumes of paperwork that are before you. You’re not sure whether a particular clause should be in the purchase agreement . . . you find something new in the contract that wasn’t part of your negotiations . . . you wonder if there are any clauses that are not in the contract that you should insist upon including before signing.
Perplexed, you turn to your agent or broker who is not an attorney and ask all these questions. Unfortunately, they have a simple answer for all of your questions: “Since I am not an attorney, I am prohibited by law in providing you with an opinion on that matter. I can tell you, however, that your signature goes by the little ‘X’.” How frustrating is that?
Similarly, if selling a property you may have important questions with potentially far-reaching implications on your bottom line. For example: “What are the tax implications of a short sale? If I sell my property for less than the mortgage balance, can the bank come after me for the deficit? Buying or selling a home is a transaction involving a number of legal issues that demand vigilance. The chain of title for the property must be free of defects. Are there any current or potential liens that could negatively affect your ownership? What are the current zoning regulations and will they defeat your intended use of the property? Are there any encroachments, repair issues, or lawsuits affecting the property?
Again, the average agent or broker may be able to alert you to the existence of any of these problems, but when you ask the obvious follow-up question of how you should address the issue, guess what familiar response you’ll get? . . . . “Since I am not an attorney, I am prohibited by law in providing you with an answer to your question.” If only you had someone advising you who was both a broker AND an attorney - The Gordon Professional Group is your answer
